New legal dispute in Tennessee arises over proposed law blocking challenges to House rules in state court – Tennessee Lookout


On Wednesday, the House State Government Committee passed legislation that would remove state courts from challenges of House rules, despite potential legal battles. Lead plaintiff Allison Polidor, who previously sued the House over sign rules, called the measure a “power play” and threatened to sue again if it becomes law. The bill, sponsored by Rep. Gino Bulso, would limit state court jurisdiction over cases involving House and Senate rules, moving such challenges to federal court or the Tennessee Supreme Court.

Critics argue that the bill violates the state Constitution and limits checks and balances on the Legislature. Bulso maintains that the First Amendment does not apply to House rules and argues that the Constitution allows for secret floor sessions without judicial review. The bill is seen as a response to disruptions during House sessions, including a protest against gun violence that led to the expulsion of two lawmakers.

Polidor and other opponents of the bill criticize the attempt to limit judicial oversight and checks on legislative power. They argue that the legislation is unconstitutional and undermines the principles of the separation of powers. Despite concerns raised by Democrats and some Republicans, the committee voted in favor of the bill. If passed, it could have significant implications for the ability of individuals to challenge House rules in the future.
