Tennessee committee approves ‘Danielle’s Law’ for advancement

Nashville, TN – A bill aiming to extend the statute of limitations for civil action related to sexual assault or sexual battery cases was advanced out of a House subcommittee on Wednesday. The measure, HB2216, would give victims of these crimes more time to file civil action after their assaults. Currently, Tennessee law only allows victims to file suit within one year of the incident, but this bill would give victims five years with a police report and three years without one.

The bill is sponsored by Rep. Sam Whitson and is supported by Danielle Pyle, a rape survivor who testified before the House committee in favor of the bill’s passage. Pyle, who was assaulted nearly three years ago, shared her story of filing a police report and completing a rape kit, only to find out that her case was lost and criminal charges were not pursued. Due to the current statute of limitations, Pyle was unable to pursue civil litigation against her rapist.

Pyle’s testimony highlighted the need for more time for victims to process their trauma and navigate the legal process, especially in cases where criminal charges may not be pursued. The bill, now named “Danielle’s Law” in honor of Pyle, advanced unanimously out of the House Civil Justice Committee and the Tennessee Senate.

Pyle expressed gratitude to state legislators for understanding the importance of this change, as it will give survivors the necessary time to heal and seek justice. If you or someone you know is a victim of sexual violence, there is a statewide helpline available for support.
