Tennessee farm worker discovers severed pig’s head at work station after inquiring about wages, according to complaint


The Department of Labor has filed a complaint seeking a temporary restraining order to prevent a Tennessee farm, Tosh Pork LLC, from retaliating against employees who inquired about their wages. Two employees, a husband and wife, asked about their pay and later filed a complaint with the DOL’s Wage and Hour Division. In response, Tosh Pork allegedly reassigned one worker to cleaning duties and attempted to prevent both employees from discussing pay issues with coworkers. Another worker who inquired about wages was threatened with termination and later found a severed pig’s head at their workstation.

The legal action against Tosh Pork seeks to stop violations of the Fair Labor Standards Act. A representative for the company denied the allegations of retaliation, stating that they aim to comply with all federal, state, and local regulations. The DOL’s investigation also found that Tosh Pork had not met employment requirements for H-2A visa workers and American workers under the Immigration and Nationality Act, resulting in owed back wages to five employees and civil money penalties.

The DOL emphasized that federal law protects employees who provide information to the department and engage in legally protected activities such as inquiring about pay. This case highlights the importance of upholding labor laws to ensure fair treatment of workers in agriculture and other industries.
