Controversial Bill Banning Marriage Between First Cousins in Tennessee Passes After Heated Debate


The Tennessee House passed a bill banning marriage between first cousins, but not without controversy. Republican lawmaker Rep. Gino Bulso pushed for an amendment to allow cousins to marry if they first received genetic counseling. Bulso argued that the bill, as originally written, could violate the Obergefell v. Hodges decision legalizing same-sex marriage. He stated that the risk of birth defects from first cousin marriages is low, especially for same-sex couples. However, his proposed amendment was ultimately tabled, and the bill passed in the House.

The bill now awaits Gov. Bill Lee’s signature. Two Republican lawmakers, Bulso and Rep. Monty Fritts, were the only ones to vote against the bill. The legislation was introduced by Rep. Darren Jernigan, who hopes to close the loophole allowing cousin marriages in Tennessee in 2024.

The bill was presented as a public health measure to prevent birth defects in children born to first-cousin couples. Despite the low risk, proponents argue for the prohibition on the basis of potential health consequences. Critics, on the other hand, believe that genetic counseling could mitigate these risks and allow first cousins to marry legally.

This contentious issue in Tennessee has sparked debate among lawmakers, with opposing views on whether genetic counseling should be a requirement for cousins seeking to marry. The final decision now rests with Governor Lee, as the bill heads to his desk for approval.
