Critics of CON law repeal are spreading fear and misinformation


In a recent piece, Wendy Long, CEO of the Tennessee Hospital Association, argued against repealing Certificate of Need (CON) laws, claiming it would decrease access to healthcare. However, research shows that states without CON laws actually have more hospitals and surgery centers per capita, debunking the argument that repealing CON laws would lead to hospital closures. Evidence also shows that CON laws do not increase access to care for underserved populations.

Jaimie Cavanaugh of the Pacific Legal Foundation and Jeff Mazzella of the Center for Individual Freedom point out that the fearmongering from CON beneficiaries should not guide legislative reforms, and policymakers should instead rely on research when considering CON law repeal.

States without CON laws have shown that more facilities can thrive without the constraints of CON laws, and safety-net hospitals have even had higher profit margins in states that have gotten rid of CON laws. Therefore, policymakers should take into account the evidence that repealing CON laws may actually improve access to healthcare, rather than listening to the arguments of those who benefit from the current system.
