Nordstrom and Patagonia settled a counterfeiting lawsuit after Patagonia accused Nordstrom of selling thousands of fake Patagonia products through its Nordstrom Rack stores. The lawsuit, filed in May 2023, claimed that Nordstrom’s customers expected genuine Patagonia products and that the counterfeit items misrepresented the quality and conditions in which they were made.
After both retailers signed a settlement agreement, Patagonia dismissed the lawsuit against Nordstrom. Nordstrom removed the fake products from its stores and terminated its relationship with the third-party vendor, Razaz Group, from New Jersey where the products were purchased. However, Nordstrom still has a third-party complaint against Razaz Group, accusing the vendor of supplying the counterfeit products.
Patagonia, based in California, has spent years establishing its brand as one of quality and fair labor practices, and the counterfeit products sold by Nordstrom threatened to damage that reputation. Before filing the lawsuit, Patagonia had asked Nordstrom to recall the products or reimburse customers, but Nordstrom did not take action, leading to the legal action.
The lawsuit highlights the importance of maintaining product authenticity and ethical business practices in the retail industry. Nordstrom’s spokesperson emphasized the company’s commitment to quality and integrity, while Patagonia’s lawsuit sought to protect its brand from counterfeit products that could mislead customers. The outcome of the settlement agreement resolves the legal dispute between the two retailers, but the third-party complaint against Razaz Group is still ongoing.
