Segregation of Thousands with Disabilities Found in Three States


The Department of Justice conducted extensive investigations into how Missouri, Utah, and Nebraska have illegally segregated people with mental health disabilities. Reports from these investigations reveal that thousands of individuals are unnecessarily institutionalized in state facilities, cut off from their families and society as a whole. The investigations were initiated due to numerous complaints and violations of the Americans with Disabilities Act, which emphasizes the need for individuals with disabilities to live in integrated settings.

The investigation of Missouri revealed that the state systematically funneled people into state nursing facilities, even though most did not require the care offered. Individuals reported prison-like conditions in these facilities, with stringent rules limiting their interactions with loved ones and the community. Similar segregation practices were found in Utah and Nebraska, where individuals with disabilities were placed in isolated day programs and living facilities.

The federal reports highlighted the need for community-based services to prevent segregation and provide individuals with disabilities the opportunity to live independently. Alternatives to institutionalization include assertive community treatment, permanent supportive housing, peer support services, mobile crisis services, and crisis stabilization services. The investigations aim to enforce compliance with the ADA’s integration mandate and end the unnecessary segregation and isolation of individuals with disabilities.

The findings of the investigations have prompted commitments from the states to improve their treatment of individuals with disabilities. However, the reports shed light on the challenges faced by individuals who have been caught in the cycle of institutionalization due to court-appointed guardianships. The investigations underscore the importance of providing individuals with disabilities the opportunity to live fulfilling lives within their communities, in accordance with their rights under the ADA.
