The prosecutor in former President Donald Trump’s federal election interference case has secured a new indictment against Trump, following the Supreme Court’s decision in July that Trump had broad immunity from charges relating to official acts as president. The new indictment removed allegations against an unindicted co-conspirator, Jeffrey Clark, who had helped Trump pressure the Justice Department to overturn the results of the 2020 election. The indictment stated that Trump spread lies about election fraud and tried to use the Justice Department to open baseless investigations to influence state legislatures. The Supreme Court ruled that Trump cannot be prosecuted for conduct within his exclusive constitutional authority, leading to changes in the indictment. Unindicted co-conspirators are now listed as “private” lawyers and consultants, including Rudy Giuliani, Sidney Powell, and others who promoted Trump’s claims of fraud in the election. The judge presiding over the case must decide which charges can survive the Supreme Court’s ruling, as Trump has argued for dismissal but arguments about the charges are scheduled to be submitted soon.
